These Terms & Conditions (“Terms”) govern your use of the Check In Circle mobile application (the “App”) operated by Kamm Creative (“we”, “our”, or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Description of Service
Check In Circle is a personal safety application that allows you to schedule periodic check-ins verified by biometric authentication or passcode. If you miss a check-in and do not respond within your configured response window, the App escalates by notifying your designated trusted contacts via push notification, SMS, or email.
Check In Circle is not an emergency service. The App does not contact 911 or any emergency responders. It is a communication tool that notifies people you have personally designated. We do not guarantee message delivery, response times, or availability of third-party services (SMS, email, push notifications).
2. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent that you meet this requirement.
3. Account and Authentication
- Your account is identified by your phone number. You are responsible for maintaining access to your phone number.
- Check-ins are verified using device biometrics (Face ID, Touch ID, fingerprint) or a 4-digit passcode. You are responsible for keeping your passcode secure.
- You must not share your account credentials or allow others to check in on your behalf, as this defeats the safety purpose of the App.
4. Trusted Contacts
- You may designate one or more trusted contacts who will be notified if you miss a check-in.
- By adding a trusted contact, you represent that you have a reasonable basis to designate that person and that they would expect to hear from you in a safety context.
- Trusted contacts with email as their preferred contact method will receive a verification email and must accept before they are activated.
- Trusted contacts with a phone number receive an SMS verification request and must reply YES to opt in before receiving any further messages.
- We send transactional SMS and email messages to trusted contacts solely for verification, missed check-in alerts, check-in recovery notifications, and vault access notifications. We will never contact them for marketing purposes.
5. SMS Communications
By providing your phone number to create an account, you consent to receive transactional SMS messages from Check In Circle related to the core safety check-in service, including verification codes, check-in escalation alerts, and recovery notifications. You will never receive marketing or promotional messages.
Message Types and Frequency
- Primary users: SMS is used as a fallback when push notifications cannot be delivered. Typical frequency is 0–1 messages per day.
- Trusted contacts: SMS is sent for contact verification (one-time), missed check-in alerts, check-in recovery notifications, vault access notifications, and vault viewer verification codes. Frequency depends on the primary user’s check-in schedule and is typically very low.
Opt-Out
Any SMS recipient may reply STOP at any time to immediately opt out of all future SMS messages from Check In Circle. Reply HELP for support information. Opting out of SMS does not delete your account or remove you as a trusted contact — it only stops SMS delivery.
Message and Data Rates
Standard message and data rates may apply depending on your mobile carrier and plan.
Third-Party SMS Provider
SMS messages are delivered via Twilio. Your phone number is shared with Twilio solely for the purpose of delivering these transactional messages. See our Privacy Policy for more details.
6. Subscriptions and Billing
Check In Circle offers the following subscription plans:

General Terms
- Free trials automatically convert to a paid subscription unless cancelled before the trial period ends.
- Subscriptions renew automatically at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period.
- We reserve the right to change subscription pricing. Existing subscribers will be notified before any price change takes effect on their next renewal.
Apple App Store (iOS)
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
- You may manage and cancel your subscription at any time by going to Settings > [your name] > Subscriptions on your Apple device.
- Refunds are handled by Apple according to their refund policy.
- Free trial eligibility is determined by Apple. If you have previously redeemed a free trial, you may not be eligible for another.
Google Play Store (Android)
- Payment will be charged to your Google Play account at confirmation of purchase.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
- You may manage and cancel your subscription at any time by going to Google Play > Menu > Subscriptions on your Android device.
- Refunds are handled by Google according to their refund policy.
- Free trial eligibility is determined by Google Play. If you have previously redeemed a free trial, you may not be eligible for another.
Web
- Web subscriptions are billed through Stripe. Payment is charged to the payment method you provide at checkout.
- You may manage and cancel your subscription through the account management link provided in your confirmation email or within the App.
- Refund requests for web subscriptions should be directed to support@checkincircle.co.
Lifetime Membership
- The Lifetime membership is a one-time payment that grants permanent access to all Check In Circle features with no recurring charges.
- Lifetime memberships are available exclusively through the Check In Circle website.
- Lifetime access is tied to your account and is non-transferable.
- Refund requests for lifetime memberships must be submitted within 14 days of purchase by contacting support@checkincircle.co. After 14 days, lifetime purchases are non-refundable.
7. Vault
The vault feature allows you to store sensitive personal information (such as medical details, legal documents, financial accounts, and care instructions) that can be released to your designated trusted contacts if you miss a check-in and the escalation process completes.
- Your control: You decide what information to store, which trusted contacts can access which vault sections, and the delay period before release.
- Encryption: All vault contents are encrypted using AES-256-GCM envelope encryption via Google Cloud KMS. See our Privacy Policy for details.
- Timed release: Vault sections are only made accessible to granted contacts after the configured delay period following a missed check-in escalation. You can check in at any time during this window to cancel the release.
- Revocation: You can revoke a trusted contact’s access to any vault section at any time, even after release has begun.
- Deletion: When you delete your account, all vault data — including encrypted contents, attachments, and access grants — is permanently and irrecoverably deleted from our servers. Vault data cached on your device is destroyed when you log out.
8. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or to facilitate illegal activity.
- Abuse the escalation system by intentionally triggering false alerts.
- Add trusted contacts without a reasonable relationship or expectation of contact.
- Attempt to reverse engineer, decompile, or extract the source code of the App.
- Interfere with or disrupt the App’s infrastructure or other users’ use of the service.
- Use automated means to interact with the App.
9. Service Availability and Limitations
- We strive to maintain reliable service but do not guarantee uninterrupted availability. The App depends on third-party services including cloud infrastructure, SMS providers, email delivery, and push notification networks.
- Scheduled maintenance or outages may temporarily prevent check-in reminders, escalation notifications, or trusted contact alerts from being delivered. We are not liable for any consequences arising from delayed or undelivered notifications.
- The App is not a substitute for emergency services, medical monitoring, or professional safety systems.
10. Intellectual Property
The App, its design, code, content, and branding are the property of Kamm Creative and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.
11. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
12. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The App will meet your specific safety requirements.
- Notifications will be delivered successfully in all circumstances.
- The App will be error-free or uninterrupted.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Kamm Creative shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of life, personal injury, or property damage, arising out of or related to your use of or inability to use the App.
Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless Kamm Creative from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your designation of trusted contacts.
15. Account Termination
- You may delete your account at any time from within the App. This will permanently remove your data, including your check-in history, schedule, vault contents, and trusted contacts.
- We reserve the right to suspend or terminate accounts that violate these Terms or abuse the service.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the “Last updated” date. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
